If your company is faced with a complaint an employee filed with a government agency or a lawsuit one of the first questions that will be asked is if an employee handbook has been provided to employees. Then you will be asked if the handbook contains the policy that applies to the complaint and/or legal case. If not, it is likely that you will be held liable for violating an employment law and infringement of the employee’s rights. Nowhere is this more important than when dealing with sexual harassment claims.
To be enforceable and to guard against accusations of improper employer conduct, company rules must be communicated and consistently enforced.
